Welcome to Tap, a digital video-on-demand and streaming platform operated by BREAKUP ENTERTAINMENT (“BREAKUP ENTERTAINMENT”, “we”, “us”, or “our”).

These Terms and Conditions (“Terms”) govern your access to and use of the Tap mobile application, the website streamingnow.in, and all related websites, applications, digital platforms, features, services, and content operated or made available by BREAKUP ENTERTAINMENT (collectively, the “Platform” or “Services”).

By accessing, browsing, registering for, purchasing, or otherwise using the Platform or Services, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.

If you do not agree with these Terms, you must not access or use the Platform or Services.

  1. ABOUT TAP

Tap is a digital video-on-demand (“VOD”) and entertainment streaming platform operated by BREAKUP ENTERTAINMENT.

Tap is available through its mobile application and through its website at streamingnow.in.

The Platform may provide access to movies, web series, short films, videos, audio-visual productions, trailers, promotional materials, and other digital entertainment content (“Content”).

Content may be provided through free access, paid access, pay-per-view, or other access models that may be introduced by BREAKUP ENTERTAINMENT from time to time.

BREAKUP ENTERTAINMENT reserves the right to add, modify, suspend, restrict, or discontinue any Content, feature, service, pricing, access method, or functionality of the Platform, subject to applicable law.

  1. ACCEPTANCE OF THESE TERMS

These Terms constitute a legally binding agreement between you and BREAKUP ENTERTAINMENT regarding your use of Tap and the Services.

By using the Platform, you agree to comply with:

  • our Refund and Cancellation Policy;

  1. LICENSE TO USE THE PLATFORM

Subject to your compliance with these Terms and any applicable payment or access conditions, BREAKUP ENTERTAINMENT grants you a limited, personal, non-exclusive, non-transferable, revocable right to access and use Tap and view the Content made available through the Platform for your personal, non-commercial entertainment purposes.

This permission does not transfer ownership of the Platform or any Content to you.

You may not use the Platform or Content for commercial purposes unless expressly authorized in writing by BREAKUP ENTERTAINMENT or the applicable rights holder.

  6. circumvent, disable, interfere with, or attempt to bypass technological protection or access-control measures;
  7. use bots, scripts, scraping tools, automated systems, or similar methods to access or obtain Content;
  8. access Content through unauthorized third-party applications or services;
  9. use Content for commercial purposes without authorization; or
  10. assist or encourage another person to engage in any prohibited activity.

Unauthorized use of Content may result in suspension or termination of your account and may result in legal action where appropriate.

  1. INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights relating to Tap, streamingnow.in, and the Content available through the Platform, including but not limited to:

  • movies;
  • videos;
  • web series;
  • photographs;
  • artwork;
  • graphics;
  • logos;
  • trademarks;
  • service marks;
  • text;
  • music;
  • audio;
  • software;
  • designs;
  • user-interface elements; and
  • other materials

are owned by, licensed to, or otherwise lawfully made available to BREAKUP ENTERTAINMENT and/or the applicable rights holders.

Nothing in these Terms grants you ownership of any intellectual property belonging to BREAKUP ENTERTAINMENT or any third party.

Unauthorized use, reproduction, distribution, modification, or exploitation of such intellectual property is prohibited.

  1. COPYRIGHT AND INTELLECTUAL PROPERTY COMPLAINTS

If you believe that any Content available on Tap infringes your copyright or other intellectual property rights, you may contact BREAKUP ENTERTAINMENT with sufficient information and supporting documents regarding the alleged infringement.

We may review the complaint and take appropriate action in accordance with applicable law.

  1. PAYMENTS AND PAID CONTENT

Certain Content or Services on Tap may require payment.

Before completing a paid transaction, the applicable price and relevant access conditions will be displayed to you.

You agree to provide accurate payment information and authorize the applicable payment service provider to process your transaction.

Payments may be processed through third-party payment gateways or other authorized payment service providers. Their respective terms and policies may also apply.

BREAKUP ENTERTAINMENT does not guarantee the uninterrupted availability or operation of any third-party payment service.

  1. CANCELLATION AND REFUNDS

Tap does not currently provide automatic recurring subscriptions or automatic subscription renewals, unless expressly stated otherwise at the time of purchase.

Unless otherwise expressly stated by BREAKUP ENTERTAINMENT or required under applicable law, payments for digital Content or Services are non-refundable once the purchased Content or Service has been successfully provided, activated, accessed, or made available to the user.

If your payment has been successfully deducted but the purchased Content or Service has not been activated or made available due to a technical or transaction-related issue, you may contact us for assistance.

Any refund that is required by applicable law or approved by BREAKUP ENTERTAINMENT will be handled in accordance with our Refund and Cancellation Policy.

Nothing in these Terms limits any mandatory consumer rights or remedies available to you under applicable law.

  1. THIRD-PARTY SERVICES

Tap may use or integrate with third-party services, including payment gateways, hosting providers, analytics services, authentication services, advertising services, app stores, and other technology providers.

  • compatible with every device; or

We reserve the right to modify, suspend, or temporarily discontinue any portion of the Platform when reasonably necessary.

  1. DISCLAIMER

To the maximum extent permitted by applicable law, Tap, streamingnow.in, and the Services are provided on an “AS IS” and “AS AVAILABLE” basis.

BREAKUP ENTERTAINMENT does not guarantee that the Platform will always operate without interruption or errors or that particular Content will always remain available.

You acknowledge that your use of the Platform is at your own discretion and risk.

Nothing in these Terms excludes or limits any rights, warranties, remedies, or liabilities that cannot lawfully be excluded or limited under applicable law.

  1. LIMITATION OF LIABILITY

  1. SUSPENSION AND TERMINATION

BREAKUP ENTERTAINMENT may suspend, restrict, or terminate your access to Tap or your account where reasonably necessary, including if:

  • you violate these Terms;
  • you engage in fraudulent or unlawful activity;
  • you misuse the Platform or Content;
  • your actions create a security or legal risk;
  • we are required to do so by law or lawful authority; or
  • we reasonably believe that such action is necessary to protect the Platform, our users, or our rights.

Where required or appropriate, we may provide notice before taking such action.

You may stop using the Platform at any time.

Termination or suspension will not affect provisions that by their nature are intended to continue after termination, including provisions concerning intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute-related provisions.

  1. CHANGES TO THE PLATFORM

BREAKUP ENTERTAINMENT may modify, update, suspend, or discontinue any part of Tap or streamingnow.in, including Content, features, functionality, pricing, access methods, or technical requirements.

Where required by applicable law, we will provide appropriate notice and comply with applicable requirements.

  1. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of India.

Nothing in these Terms shall deprive a consumer of any mandatory rights or remedies available under applicable Indian law.

  1. JURISDICTION

Subject to applicable consumer protection laws and any mandatory jurisdictional rights available to users, disputes arising out of or relating to these Terms or your use of Tap or streamingnow.in shall be subject to the jurisdiction of the competent courts in India having lawful jurisdiction over the matter.

  1. SEVERABILITY

If any provision of these Terms is determined by a competent court or authority to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.

  1. NO WAIVER

These Terms, together with our Privacy Policy, Refund and Cancellation Policy, and any other policies expressly incorporated into these Terms, constitute the agreement between you and BREAKUP ENTERTAINMENT concerning your use of Tap and streamingnow.in, except where otherwise required by applicable law.
